For homeowners who’ve lived in their homes for 15, 20, 30, or even 40 years—a common scenario for those over 55—the smoke detectors currently installed in your home most likely do not meet current state requirements. Massachusetts law mandates that sellers obtain a certificate of compliance for smoke and carbon monoxide detectors before closing. This certificate is issued after a successful inspection by the local fire department, which will not sign off unless all devices are up to the state standards.
If your detectors fail inspection, your closing could be delayed and you could face an unexpectedly high bill for installing new detectors in a rush.
Unfortunately, many sellers—especially older adults—don’t realize this until the last minute. That’s why it’s so important to address smoke detector compliance early in your home-selling journey.
What the Massachusetts Fire Code Requires

If your home was built or renovated after 1997, it may require hardwired, interconnected detectors. But for most older homes in Massachusetts, code-compliant battery-operated detectors may be sufficient.

Here’s the issue that trips up many senior home sellers: if your smoke detectors are more than 10 years old, they will not pass the mandatory inspection. And carbon monoxide detectors that are more than 10 years old likely won’t pass either.
Over the years, requirements regarding placement of detectors have changed, so even if you have replaced your detectors, they may not be in the right locations in your home.

How to Fix the Problem Before It Becomes One
The good news is that compliance is relatively simple—when handled early.
First, check the date of manufacture printed on the back of every detector in your home. If a detector is more than 10 years old—or if there’s no date at all—it should be replaced. You’ll see online that carbon monoxide detectors should be less than seven years old, but this is just a recommendation; 10 years of age is the cut-off point.
Replace any battery-powered smoke detectors with 10-year sealed photoelectric units with hush buttons. Brands such as Kidde and First Alert offer Massachusetts-compliant models, readily available at hardware stores or online. These are easy to install and typically cost $30–$60 each. For homes with wired detectors, replacement may not require a licensed electrician, but you do need to know what you are doing when installing replacement hard-wired detectors. That’s another reason to begin the process sooner rather than later.
Finally, schedule your local fire department’s inspection well before your closing date. They’ll conduct a walk-through to confirm placement and functionality of all detectors and issue the required certificate.
